2. GENERAL INFORMATION

This privacy policy applies to our website www.vc-video.com. Linked third-party websites are subject to their own privacy policies; we have no influence over their content or their data processing.

Personal data means any information relating to an identified or identifiable natural person (Art. 4 no. 1 GDPR). We process such data only where this is permitted by law or where you have given your consent.

Our website can generally be used without providing personal data. However, the processing of certain data is unavoidable for the technical provision of the site; please see sections 3 and 4.

Our website is delivered exclusively over an encrypted connection (HTTPS/TLS). You can recognise this by the padlock symbol in your browser's address bar. Nevertheless, complete security of data transmission over the internet cannot be guaranteed according to the current state of technology.

 

3. WEBSITE HOSTING

This website is operated on the Wix platform. The provider is Wix.com Ltd., based in Israel.

Wix provides the technical infrastructure for the operation, storage and delivery of this website. In doing so, Wix processes all data that arises technically when the website is accessed or that you transmit to us via the website — in particular IP address, time of access, pages viewed, browser and device information as well as the content of forms. For this purpose, Wix sets its own technically necessary cookies; please see section 5.

Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest lies in providing our online offering securely, reliably and economically. Where consent is required for storing information on your device or accessing information already stored there, this is governed by Section 25 TDDDG (German Telecommunications Digital Services Data Protection Act).

Data processing agreement: A contract on the processing of personal data pursuant to Art. 28 GDPR is in place with Wix.

Third-country transfer: The transfer to Wix.com Ltd. in Israel is based on the European Commission's adequacy decision for Israel (Decision 2011/61/EU). Wix additionally engages sub-processors, some of them in countries outside the European Economic Area. For such onward transfers, Wix has contractually undertaken to conclude the European Commission's Standard Contractual Clauses (Implementing Decision (EU) 2021/914) or to provide equivalent safeguards pursuant to Art. 46 GDPR.

4. SERVER LOG FILES

Each time our website is accessed, information transmitted by your browser is automatically recorded and stored in log files. The following data is recorded:

• the address accessed and, where applicable, the previously visited page

• date and time of access

• name and address of the file retrieved

• volume of data transferred and notification of successful retrieval

• browser type and version as well as the operating system of your device

• the requesting internet provider and the IP address of your device

Purpose: This data serves to establish connections without errors, to enable convenient use of the website and to ensure the security and stability of our systems. We do not merge this data with other data sources, and we do not use it to identify individual visitors.

Legal basis: Art. 6(1)(f) GDPR. Our legitimate interest arises from the purposes stated above.

Retention period: Server log files are stored by our hosting provider Wix as part of the technical operation of the website. The retention period is determined by Wix; we have no influence over it. We do not carry out any separate or additional logging of our own.

 

5. COOKIES AND YOUR CONSENT

Our website uses cookies. These are small text files stored on your device. The same applies to comparable techniques of storage in your browser.

A consent banner appears the first time you access our website. Before you make a selection there, only technically necessary cookies are set. All other categories are deactivated by default.

We distinguish four categories:
 

• Strictly necessary cookies enable the operation of the website, for example session management, security, language settings and error handling. Without them the website does not function as intended; they therefore cannot be deselected.

• Functional cookies store information you have already entered and enable more convenient features based on it.

• Analytics cookies serve to analyse the use of our website. This category also covers the integration of Google Maps (section 8).

• Marketing cookies serve to measure the effectiveness of advertising and to record visitor interests. This category also covers the integration of our video player (section 9).
   

Legal basis: For strictly necessary cookies this is Section 25(2) no. 2 TDDDG, and Art. 6(1)(f) GDPR for the subsequent processing. For all other categories it is your consent pursuant to Section 25(1) TDDDG in conjunction with Art. 6(1)(a) GDPR.

Withdrawal: You may withdraw your consent at any time with effect for the future. To do so, click the "Cookie-Einstellungen" (cookie settings) button at the bottom left of every page. There you can review and change your selection at any time. The lawfulness of processing carried out before withdrawal remains unaffected.

Independently of this, you can delete cookies in your browser settings or restrict their storage. In that case, some functions of our website may not be available to you.

 

6. CONTACTING US

 

CONTACT FORM

If you send us an enquiry via the contact form, we process the data you provide — first name, surname, email address, telephone number, address and the content of your message — exclusively in order to process and answer your enquiry. Transmission is encrypted. The form data is stored in the infrastructure of our hosting provider (section 3).

 

EMAIL AND TELEPHONE

If you contact us by either of these means, we likewise process the data arising exclusively in order to deal with your request.

Legal basis: If your enquiry relates to a contract or to steps taken prior to entering into a contract, this is Art. 6(1)(b) GDPR. In all other cases we rely on Art. 6(1)(f) GDPR — our legitimate interest in answering enquiries addressed to us.

Retention period: We delete the data as soon as your request has been dealt with conclusively and no statutory retention obligations apply. Where the correspondence constitutes business correspondence, the commercial and tax retention periods of six and ten years respectively apply (Section 257 HGB, Section 147 AO — German Commercial Code and Fiscal Code).

 

7. JOB APPLICATIONS

If you apply to us, we process the data you submit — such as contact details, cover letter, curriculum vitae and references — exclusively for the purpose of conducting the application procedure.

Legal basis: Section 26(1) BDSG (German Federal Data Protection Act) in conjunction with Art. 6(1)(b) GDPR. The processing is necessary for the decision on entering into an employment relationship.

Retention period: If no employment relationship is established, we delete your application documents six months after the procedure has been concluded. This period takes into account the time limits for asserting claims under the German General Equal Treatment Act. If you would like us to consider your documents for future positions beyond that period, we will obtain your separate consent, which you may withdraw at any time.

 

8. GOOGLE MAPS

On our contact page we embed map material from the Google Maps service in order to show you our location. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

The map is only loaded once you have consented to the "Analytics" category. Until then you will see a placeholder in its place, and no connection to Google is established. Following your consent, your IP address is transmitted to Google when the map loads, irrespective of whether you have a Google account. If you are logged in to Google, Google can attribute your use to your account.

9. EMBEDDED VIDEOS

On our website we embed videos provided by Vimeo.com, Inc., 330 West 34th Street, New York, NY 10001, USA.

The video player is only loaded once you have consented to the "Marketing" category. Until then you will see a placeholder in its place, and no connection to Vimeo is established. Following your consent, a connection to Vimeo's servers is established; in the process, your IP address and information about which of our pages you have visited are transmitted to Vimeo, and cookies are stored on your device. If you have a Vimeo account and are logged in, Vimeo can attribute your use to your account. Vimeo may combine this data into usage profiles. You have the right to object to the creation of such profiles; to exercise it, please contact Vimeo directly.

10. OUR SOCIAL MEDIA PROFILES

At the foot of our website we link to our profiles on Vimeo, Instagram, Facebook and LinkedIn. These are plain hyperlinks, not embedded content or plug-ins. No data is transmitted to these providers until you actively click one of the links. From that point onwards, the privacy policies of the respective provider apply, over which we have no influence.

 

11. TRANSFERS TO THIRD COUNTRIES

Where personal data is processed outside the European Union and the European Economic Area, we ensure that one of the bases set out in Chapter V GDPR applies.

Israel: The transfer to our hosting provider is based on the European Commission's adequacy decision for Israel (Decision 2011/61/EU). Onward transfers to sub-processors in further third countries take place on the basis of the European Commission's Standard Contractual Clauses or equivalent safeguards pursuant to Art. 46 GDPR.

United States: Google Maps and the Vimeo video player are loaded exclusively after your express consent. The associated transfer to the USA takes place on the basis of that consent pursuant to Art. 49(1)(a) GDPR. In this context we expressly point out that access by state authorities to your data for monitoring and surveillance purposes cannot be ruled out in the United States, that appropriate safeguards for the protection of your data may not exist in this respect, and that the same legal remedies may not be available to you there as within the European Union. Insofar as the aforementioned providers additionally hold certification under the EU-US Data Privacy Framework or have concluded Standard Contractual Clauses, these apply in addition.

 

12. RETENTION PERIODS

We store personal data only for as long as is necessary for the respective purposes or as required by statutory retention obligations, in particular under commercial and tax law. Specific periods are stated with the individual processing activities. Once the purpose ceases to apply and no retention obligations exist, the data is deleted or anonymised.

 

13. YOUR RIGHTS

You have the following rights in relation to your personal data:
 

• Access (Art. 15 GDPR): You may request information as to whether and which data we process about you.

• Rectification (Art. 16 GDPR): You may request that inaccurate data be corrected or that incomplete data be completed.

• Erasure (Art. 17 GDPR): You may request the erasure of your data, provided no statutory retention obligations prevent this.

• Restriction of processing (Art. 18 GDPR): You may request that the processing of your data be restricted.

• Data portability (Art. 20 GDPR): You may request to receive the data you have provided to us in a structured, commonly used and machine-readable format, or to have it transmitted to another controller.

• Objection (Art. 21 GDPR): Please see section 14.

• Withdrawal of consent (Art. 7(3) GDPR): You may withdraw consent once given at any time with effect for the future. The lawfulness of processing carried out up to that point remains unaffected.

• Complaint to a supervisory authority (Art. 77 GDPR): Please see section 15.

14. RIGHT TO OBJECT

You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Art. 6(1)(f) GDPR. If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or unless the processing serves to establish, exercise or defend legal claims.

Where your personal data is processed for direct marketing purposes, you have the right to object to such processing at any time and without giving reasons. Following such an objection, we will no longer use your data for that purpose.

15. RIGHT TO LODGE A COMPLAINT WITH A SUPERVISORY AUTHORITY

If you consider that the processing of your personal data infringes the GDPR, you may lodge a complaint with a supervisory authority, without prejudice to any other legal remedy, in particular in the Member State of your habitual residence, place of work or the place of the alleged infringement.

16. NO AUTOMATED DECISION-MAKING

Automated decision-making, including profiling, within the meaning of Art. 22 GDPR does not take place on this website.

 

17. PROVISION OF YOUR DATA

The provision of personal data is neither required by law nor by contract. However, if you wish to contact us, we require the details marked as mandatory fields in the form; without them we cannot process your enquiry.

 

18. CHANGES TO THIS PRIVACY POLICY

We will amend this privacy policy whenever changes to our website or to the legal situation make this necessary. The version available at the time of your visit applies.
